On January 17, 2013, the U.S. Department of Health and Human Services (HHS) issued a final rule (Omnibus Rule)to the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

New Business Associate Agreements (BAAs) and Data Usage Agreements (DUAs) must comply with Omnibus Rule requirements by September 23, 2013; otherwise, BAAs and DUAs that only became non-compliant after the Office for Civil Rights (OCR) released the Omnibus Rule may remain in effect until September 22, 2014 (or until the applicable agreement renewal date).

Any new BAAs must be compliant by Sept 23, 2013.
